INFORMATION ON PRIVACY AND COOKIE
Cookies are small text strings that user-visited sites send to their terminal (usually to the browser), where they are stored to be retransmitted to the same sites upon the next visit of the same user. While browsing on a site, the user can also receive cookies on his terminal that are sent from sites or other web servers (“third parties”) on which some elements (such as images, Maps, sounds, specific links to pages of other domains) on the site that the same is visiting. Cookies, commonly found in user browsers in a very large number and sometimes even with extensive time persistence, are used for different purposes: running computer authentication, session monitoring, storing information on specific configurations for users accessing Servers, etc. In order to achieve proper regulation of such devices, it is necessary to distinguish them where there are no technical characteristics that differentiate them from each other on the basis of the purposes pursued by those who use them. In this direction, however, the same legislator moved in that, in implementing the provisions of Directive 2009/136 / EC, it had the obligation to acquire the prior informed consent of users to the installation of cookies used for purposes Other than merely technical techniques (see Article 1, paragraph 5, letter a) of the d. lgs. May 28, 2012, no. 69, which amended art. 122 of the Code). In this respect, and for the purpose of this provision, two macro-categories are identified: technical cookies and “profiling” cookies.
a. Technical Cookies. Technical cookies are only used to “transmit a communication on an electronic communications network or to the extent strictly necessary for the information society service provider explicitly required by the subscriber or user to provide Such service “(see Article 122 (1) of the Code). They are not used for further purposes and are normally installed directly by the owner or web site manager. They can be subdivided into navigation or session cookies that ensure the normal browsing and use of the website (allowing, for example, a purchase or authentication to access restricted areas); Cookie analytics, similar to technical cookies when used directly by the site manager to gather aggregated information about the number of users and how they visit the site itself; Feature cookies that allow the user to navigate according to a set of selected criteria (for example, language, products selected for purchase) in order to improve the service rendered to them. For the installation of such cookies no prior consent of users is required, while the obligation to provide information pursuant to art. 13 of the Code, which the site manager, if he or she only uses such devices, may provide it with the most appropriate methods.
b. Profiling cookies. Profiling cookies are designed to create user profiles and are used to send advertisements in line with the preferences displayed by the same in the context of network browsing. Due to the particular invasiveness that such devices may have in the private sphere of users, European and Italian legislation provides that the user must be properly informed of their use and thus express their true consent. They refer to art. 122 of the Code where it provides that “the storage of information in the terminal of a contractor or a user or access to previously archived information is only permitted provided that the contractor or the user has given their consent after being Has been informed of the simplified procedures referred to in Article 13, paragraph 3 “(Article 122, paragraph 1 of the Code). 13.05.2013: text taken from: garanteprivacy.
